Woman Arrested in Alleged Strangulation, Battery Outside Boca Raton Movie Theater

An 18-year-old woman was arrested Thursday on charges including battery by strangulation and burglary of a vehicle following an alleged altercation with a juvenile ex-girlfriend in a movie theater parking lot, according to police.

Nicola Nosek, 18, of Delray Beach, was taken into custody shortly after 1:25 a.m. at the Cinemark theater on Airport Road, Boca Raton police said. According to a police report filed Thursday night, officers responded to a reported disturbance at the movie theater, with the juvenile victim telling officers she had exited the theater and entered her friend’s white Acura sedan when Nosek allegedly approached and a verbal argument began.

The victim alleged that Nosek prevented her from closing the driver’s door, entered the vehicle and struck her multiple times with a closed fist to the upper lip and left ear. The victim further alleged that Nosek placed both hands around her neck and squeezed, impeding her breathing to the point she nearly lost consciousness. After the alleged assault, Nosek reportedly threw a phone at the victim, police said.

Officers observed injuries, including the presence of blood, on the victim, the report stated. Witnesses told police they saw Nosek strike the victim inside the vehicle and had to intervene to separate the two. One witness also reported seeing Nosek jump onto the hood of the car in an attempt to reach the victim.

Nosek was arrested on charges of felony battery by domestic strangulation, simple battery and burglary of an occupied conveyance with the intent to commit a battery, records show. She refused to provide a statement after being read her rights, according to the affidavit. The victim’s name and those of the witnesses are being withheld in accordance with Marsy’s Law and policies protecting victims of domestic violence, particularly juveniles.

Nosek was being held in the Palm Beach County Jail in lieu of $20,000 combined bond for the three charges.
