A dinner date escalated from a disappointment at a restaurant to the alleged brandishing of a firearm in Boca Raton this week, landing one city man behind bars, charged with battery.

Derek Hurwitch, 41, remained lodged in the Palm Beach County Jail following his arrest Wednesday, after a woman with whom he went on a date called police to report an incident that allegedly occurred after the two had dinner. According to a police report, the alleged victim “clarified” during their latest outing that the two were “strictly friends,” leading Hurwitch to become upset.

The woman called police after, she said, Hurwitch “arrived at her residence unannounced and began acting erratically.” The report said at one point during the encounter, he “removed a black firearm from his person; however, he did not point the firearm at anyone and did not make any verbal threats.” The woman also told police that Hurwitch drove his Cadillac into her vehicle before leaving. She then called police to report the incident.

The report went on to state that Hurwitch called the woman while police were taking their report, and when an officer got on the phone, he allegedly became “verbally hostile, using profane and derogatory language toward me,” but said he would speak to officers at his home. Police then went to the home, leading Hurwitch to answer the door before quickly trying to close it and allegedly hurling a vulgar insult at the officer. As the officers left, Hurwitch is alleged to have come out of the residence and walked quickly towards them, at one point getting “chest to chest” with one of the cops on scene.

“Hurwitch then grabbed the upper left portion of my department-issued vest with his right hand,” the report said.

He was then arrested and ultimately transferred to the jail, where he remained Friday morning on charges of battery on a law enforcement officer and resisting without violence, in lieu of a combined $5,000 bail.
